1. Payment Terms
A 50% deposit is due upon signing any Gamut Cine package. The remaining 50% balance is due no later than seven (7) days prior to the wedding date.
2. Cancellation Policy
Contracts cancelled by the Client before an initial deposit is made will be terminated upon request at no cost to the Client.
If the Client wishes to cancel after a deposit has been made, Gamut will issue a credit to the Client. This credit is valid for one (1) year from the date the contract was executed and is non-transferable. All deposits are non-refundable.
3. Client Responsibilities & Scheduling
The Client acknowledges and agrees that Gamut's ability to meet any and all schedules depends entirely on the Client's prompt performance of its obligations to provide materials, written approvals, and/or instructions pursuant to this Proposal.
Any delay in the Client's performance, or any change to the services or deliverables requested by the Client, may delay delivery of the deliverables. No such delay caused by the Client shall constitute a breach of any term, condition, or obligation of Gamut under this Agreement.
4. Force Majeure
If Gamut is unable to perform a contracted service, in whole or in part, due to fire or other casualty, acts of God or nature, acts of terror, or any other cause beyond the control of the parties, Gamut shall not be held liable and no refund will be issued for any prior deposits.
5. Illness or Injury
If Gamut is unable to perform a contracted service due to the illness or injury of a Gamut staff member, Gamut will return all fees paid, less any costs already incurred by Gamut, and shall have no further liability with respect to this Agreement.
6. Loss or Damage of Materials
If video, photographs, or media materials are damaged during processing, lost due to camera malfunction, lost in transit, or otherwise lost or damaged, Gamut will return all fees paid.
7. Overtime
If Gamut is asked to remain on site beyond the contracted time, an additional charge of $500 per hour will apply.
8. On-Site Requirements
For all on-site productions, the Client must ensure that Gamut is provided with a designated space at the location or venue to store its equipment, so that it does not obstruct guests or customers.
9. Travel
Travel fees are included for all services contracted within Miami-Dade or Broward County. For services outside these areas, the contracting Client is responsible for providing travel and lodging.
10. Copyright & Usage
As the author of all images produced hereunder, and as provided for by law, Gamut retains the copyright in perpetuity, regardless of possession or ownership of negatives, photographs, digital images, or video files in any other format of reproduction.
The contracting Client has the option to purchase the raw media and editable files, if desired. It is further understood that any and all rights to proofs and final media shall remain the property of Gamut and may be used for social media, advertising, display, or any other purpose Gamut deems appropriate. Gamut agrees not to sell such material to any third party for advertising purposes.
